Is selling art a business like any other ?

    When you look at an artwork and marvel at its charm, it is easy to think that it is the result of pure artistic inspiration. However, behind this beauty and admiration there are often complex commercial issues. We are talking here about auctions at record prices, opaque transactions and exorbitant prices that are often widely publicised in the art world. So how does the sale of works of art work ?

    The art market, an environment that shows no signs of slowing down

    The art market is constantly evolving. Moreover, it shows no signs of slowing down. The demand for contemporary, classical and other art styles remains high. Indeed, many art collectors are willing to invest in unique works of art. In addition, there is a growing trend among some artists and art lovers. They are increasingly interested in environmentally friendly interior design. Nowadays, eco-friendly interior design is being promoted by art lovers who take environmental issues into account. Art lovers are interested because they consider this approach as a selection criterion for the artworks they buy.

    The legislation governing the sale of works of art in France

    In France, the sale of works of art is subject to specific legislation. And it is important to understand the rules and laws that govern the art market in the country in order to sell your work legally.

    What is a work of art under French law ?

    According to Article L111-1 of the French Intellectual Property Code, to be considered a work of art, an artistic creation must meet two cumulative criteria: it must be material and tangible and it must reflect the personality of the author, i.e. be original.

    Who can sell works of art under French law ?

    The sale of works of art in France is mainly regulated by the law of 10 July 2000. This law governs public auctions and voluntary sales of cultural goods. It stipulates that only authorised auctioneers may organise public auctions. Online art platforms, art galleries and other sales channels are also allowed to sell works of art. However, they must comply with the laws and regulations governing the sale of art.

    What is the tax legislation on the sale of works of art in France ?

    When you sell a work of art as a private individual in France, you must pay a specific tax of 6% on the sale price. In addition, if you are a French tax resident, according to the legislation in force, you will be subject to a Contribution au Remboursement de la Dette Sociale (CRDS) of 0.5% in addition to the specific 6% tax on the sale price of works of art. However, it is worth noting that sales with a selling price of less than 5,000 euros are exempt from this tax.

    Some basic principles to apply when selling your work

    If you are an artist, selling your work can be a real challenge. However, by applying a few basic principles, it is possible to maximise your chances of selling.

    Pricing and diversification of sales channels

    It is important to set a realistic price for artworks. To do this, you should consider the following:

    • the art market,
    • the reputation of the artist,
    • the size of the work in question,
    • the state of conservation of the work.

    Apart from these elements, you should also diversify your sales channels. Art fairs, online platforms and social networks are all channels through which you can reach a wider audience to make significant sales.

    Promotion and communication

    To sell your artworks, you need to promote them and have a good communication strategy. For example, you can use the following effective means:

    • create a professional portfolio,
    • set up a website or social networking page dedicated to your art,
    • use marketing techniques such as newsletters,
    • participate in art events,
    • collaborate with other artists or art professionals.

    Whatever the medium and means chosen, art lovers must have access to your work.

    Participating in art events can also be an effective way to promote yourself as an artist. It allows you to present your work to a wider audience and meet other artists and art enthusiasts.

    Social networks are also a powerful tool for promoting your artwork. However, in order to promote yourself, you need to choose the right platforms for your style and target audience. You should also maintain an active online presence by regularly sharing your work and interacting with your followers.

    It takes time and effort to establish yourself in the art market

    Success in the art market is a process that takes time and effort. You need to adopt the right techniques and methods to achieve your goals. You also need to have an effective online presence and communication strategies adapted to the digital age to succeed in today’s technology-driven environment.
